CUPRA x Parookaville x SPINNIN' RECORDS DEMO DROP 2023 - CONTEST RULES

‘CONTEST'
A contest where contestants from Europe can enter by submitting their own and original demo (the “demo”) through the landing page, which leads to the Spinnin’ Records Talent Pool platform, by sharing their SoundCloud upload in order to win an official release with Spinnin’ Records. AND a video of their 15 (fifteen)-minute DJ set to show off their DJ skills. The contest will be running from June 8^th 2023 up and until June 25th 2023.

‘CONTEST TERMS & CONDITIONS'
The terms and conditions as set forth below. These Contest Terms & Conditions are applicable to the Contest.

‘THE PLATFORM’
Via the landingpage https://spinninrecords.com/cupra-parookavillethe Contestant shall be directed to the Spinnin Records Talent Pool Platform (All content hosted on https://spinninrecords.com/talentpool/). Including but not limited to, functionalities, contests and personal information.

‘THE ORGANIZATION’
The Organization consists of Spinnin' Records and its affiliates, and all of its employees and representatives, along with content specific artists, (endorsing) sponsors and its representatives, and agents. Contact information Spinnin' Records: Marathon 4, 1213 PJ Hilversum, The Netherlands.

‘SPECIFIC TERMS & CONDITIONS’
Specific details about the Contest, including dates, prizes and rules that are specific to each Contest. The specific terms & conditions may be found on the Contest specific webpages for each Contest.

‘TRACKS’
Tracks refers to all original audio content and remixes owned by Spinnin’ Records, its affiliates or its sublabels.

‘DEMO’
The demo must be a new and original audio production without the use of any copyright protected samples. The demo should be accompanied by all requested labelcopy details. If (royalty free) samples have been used, these must by stated in detail to Spinnin’ and must only contain samples that have been fully ‘cleared’ by the Contestant.

‘DJ-MIX’

DJ-mix/set, with a maximum of 15 (fifteen) minutes. The Contestants must be able to play live on

decks and will need to bring their own USB with music to Parookaville Festival on July 23^rd 2023.

WHO CAN ENTER?
Participants of the Contest on the Platform must first be 18 years of age or older or have written permission from their parents or legal guardians to enter into the Contest. The Contestant is at liberty to enter into this Contest and does not infringe upon the rights of any other entity. Only demos from Europe will be taken into consideration. Participants must live in Europe during the length of the competition.

You are not eligible to enter the Contest or are eligible for disqualification after entering the Contest if you:
a)     Are an employee or representative of, or artist(s) exclusively signed to The Organization or are a member of the direct family of employees, representatives of or artist(s) exclusively signed to The Organization.
b)     Do not comply with The Contest Terms & Conditions
c)     Are exclusively signed to a third-party record label.

HOW DO I ENTER?
Participants of the Contest can enter the Contest by submitting their own and original demo (the “demo”), a video of their 15 (fifteen)-minute DJ set, including requested labelcopy details, through the landingpage https://spinninrecords.com/cupra-parookaville which leads to the the Spinnin’ Records Talent Pool platform, by sharing their SoundCloud upload, to comply with the general terms and conditions of the Talent Pool website and the privacy policy and by entering their email address.
Participating in the Contest is free of charge. Any costs made for creating the demo are for the Contestant’ own account.

HOW DO I WIN?
Each Contest will have its respective set of rules set forth in the specific terms & conditions on its respective contest page. 
For each contest, The Organization will announce the winner(s) in a period of time after completion of the Contest period as set out in the specific terms & conditions. This period may be later than the day of completion of the Contest period for reasons that include but are not limited to a large amount of entries, unavailability of judges and/or technical malfunctions.

1. Submissions close on June 25th 2023 23:59 CET.
2. After submitting the demo and 15 (fifteen)-minute dj set, 10 (ten) demo’s & dj sets will be selected by Wave Wave and Spinnin’ A&R.
3. Once selected, the finalist will need to cancel allexploitation/distribution/publication elsewhere while this competition is still taking place.
4. The 10 (ten) demo’s and DJ sets will be selected during in the week of June 26 and June 30th  2023
5. Top 10 (ten) demo’s and DJ sets announced Monday July 3^rd 2023
6. The public can vote for the top 4 (four) finalists between July 3^rd 2023 and July 9^th 2023 for their favorite song on Talent Pool.
7. Top 4 (four) finalists’ announcement is on July 13^th 2023
8. The top 4 (four) will have a group call with last years winner DJ Merow July 15^th 2023
9. The top 4 (four) will each win 15 minute 1-on-1 online feedback from Wave Wave on July 19^th 2023 and July 20 2023
10. The 4 (four) finalists will battle against each other and perform a 2x 15-minute set at Parookaville at the Wacky Shack set on Sunday July 23^rd
    Round 1: Talent 1 vs. Talent 2

Round 2: Talent 3 vs. Talent 4 

Round 3: Winner Battle 1 – Winner Battle 2

Winner Announcement: 1 (one) winner announced by DJ Ambassador and performing her/his winner track on stage

11. Final track CUPRA Music Lab production in August 2023
12. Winner track is released on Spinnin’ Talent Pool on September 29th, 2023. In case of unforeseen circumstances, this date is  subject to change

By submitting your entry for the Contest on The Platform, you accept the terms of these Contest Terms & Conditions and agree to be bound by the final decisions of the judge(s).

Artist/Contestant guarantees there will be no releases on other labels during and within two (2) months after the release of the CUPRA x Parookaville x SPINNIN' RECORDS DEMO DROP 2023 on September 29th 2023 onthe Spinnin’ Records Talent Pool.

The Organization will choose the winners at its sole discretion and without giving any motivation or reasons. The Organization is not under the obligation to (and shall not) correspond with participants, in any way, about the selection of the winning Tracks.

Winners will be notified by email. If the winner has not come forward with signing his/her exclusive licensing agreement within the time period as mentioned in the timeline here above, he or she will forfeit their claim to the prize.

In case of refusal of the Prize by the winner or any other reason of non-payment of the Prize to the winner, the winner forfeits his or her claim to the prize the and The Organization will appoint a different winner. In any case, the winner forfeits their claim to the prize, if incomplete or inaccurate information uploaded to the Platform prevents the Prize Winner to be contacted.

The Organization can disqualify a participant for the Contest in its sole discretion because of, but not limited to entering a Contest outside the respective timeframe, breaking the Contest Terms & Conditions, cheating, or otherwise behaving in a disruptive manner, which may or may not give an unfair advantage compared to other participants.

All participants agree that their contact information may be shared with The Organization for use of, but not limited to, contacting the winner of the contest and for purposes set forth in the Platform’s Privacy Statement.

WHAT CAN I WIN?
The 4 (four) finalists win:
- 15-minute online feedback session with Wave Wave

- a group-call with dj merow
- Invitation for Parookaville

-Travel (economy class only), accommodation and catering will handled/covered by

the Organization.

The final winner wins:

• 1. The production of their winning track at CUPRA Music Lab Frankfurt

-     2. Release on Spinnin’ Talent Pool (Spinnin’ will have always the last say)

The Organization is not responsible or liable for any losses, taxes, damages, injury or health problems that may result from the participating in any of the contest or receiving a prize the Contest.

RIGHTS

The winners agree that the rights including but not limited to the intellectual property rights, copyrights and all other allied, ancillary and subsidiary rights in any and all media in and to the photographs, tapes, movies and recordings of winners on the Talent/CUPRA Stage at Parookaville Festival, Winner shooting at the CUPRA Music Lab/Post Contest Shoot, Promotional Activity and/or otherwise related to the Contest shall vest with Organisation and Content Partners.

Winner agree as well that the recording of the music at the CUPRA Music Labs can be used free of any royalty fees for CUPRA's Promotional Activity within all CUPRA online channels, incl. Social Media and CUPRA Websites. Film- and photo recordings from the winner in the CUPRA Lab can be used digital/online without restrictions within CUPRA channels, CLM and Parookaville websites.

MODIFICATIONS
The Organization may revise, change or alter these Contest Terms & Conditions and/or cancel, modify or suspend a specific Contest without prior notice in its sole discretion. Such changes will be made public on The Platform and/or official social media channels controlled by (employees of) The Organization. You hereby agree to be legally bound by the Contest Terms & Conditions as updated and/or modified.

MISCELLANEOUS
Despite the utmost care The Organization spends on the management of the Platform and the specific Contest webpage and the organization of the campaign, it is possible that the information provided is incomplete or incorrect. Typos or misspellings or other similar errors by The Organization’s published material of any nature whatsoever, cannot be invoked against The Organization and can in no way create an obligation for The Organization.
The Organization is not responsible for any technical problems, including the failure of the Internet, making possible participation in the Contest impossible.

The Organization is not responsible or liable for costs incurred by the participant in connection with participation in each specific Contest. The participant indemnifies The Organization from claims from third parties in connection with any breach of these Contest Terms & Conditions or in connection with the acts or omissions of the participant.

These Contest Terms & Conditions are solely governed by Dutch law. All disputes arising from of or in connection with these Contest Terms & Conditions shall solely be settled by the competent court in Amsterdam.
